OCTAVIAN HAS MORE THAN 15 YEARS OF EXPERIENCE HAVING COLLABORATED WITH THREE MAJOR LAW FIRMS IN BUCHAREST, BEING INVOLVED AND COORDINATING A SIGNIFICANT NUMBER OF LITIGATION PROJECTS.

 

HE HOLDS AN LLB IN LAW FROM THE LYON III JEAN MOULIN UNIVERSITY (FRANCE) AND A DEGREE IN COMPARATIVE LAW FROM JEAN MOULIN INSTITUTE OF COMPARATIVE LAW, LYON, FRANCE. UNTIL JANUARY 2019, OCTAVIAN HAS BEEN ONE OF THE COORDINATORS OF THE LITIGATION DEPARTMENT WITHIN A BIG4 AFFILIATED LAW FIRM, COORDINATING THE CIVIL-COMMERCIAL AND ADMINISTRATIVE-PUBLIC PROCUREMENT LITIGATION PRACTICE.

 

Octavian represented private and public major clients from different industries –  oil & gas, aviation, electronics, agribusiness, finance, automotive, construction – in a wide variety of high profile litigation and arbitration cases. He successfully acted for major companies in procedures of award of public contracts amounting to hundreds of millions of Euros, both in the administrative phase, as well as in front of courts of law. He also acted in court cases against the Romanian tax authorities, successfully defending companies in court cases whereby unlawfully established tax liabilities were annulled. In some cases, following the annulment of said tax decisions, Octavian represented his clients in claims against the Romanian State aimed at obtaining late payment interests or damages.

 

His expertise covers also other administrative lawsuits (related to European funding, annulment of different administrative deeds or regulatory matters). He acted in competition cases, challenging on behalf of his clients decisions issued by the Competition Council, whereby significant fines were imposed. Also, he was involved in drafting preliminary questions for the European Court of Justice and assisted clients with claims to the European Court of Human Rights. Octavian successfully represented his clients in a wide array of commercial arbitration and litigation cases (i.e. arbitration in Paris, Vienna or Bucharest, contractual related claims, corporate litigation, insolvency procedures, challenges against the enforcement).

 

Recently Octavian has been involved in a high profile criminal case, where the damage for alleged facts of tax evasion, misuse of the company’s assets and money laundering exceeded EUR 2.5 Bn.
